There is one company that serves coffee that is Massachusetts based and a long time company in this area. There's been other problems with this company that I was going to take to task but they were not the only offenders as in certain demographics owning franchises but they own franchises of other companies as well and they're extremely anti homeless and I will take that to task at a later time because it's a much more shaky legal issue because the people in question are a protected class and the homeless are not so you'd have to fight a lot harder and I don't think it's as alarming right now as this is urgent.
The discrimination in this particular pattern is a little more of good legal ground to stand on it has a lot of angles you can work on a case like this. We're dealing with anti-vax or nonvax discrimination. So the scenario would be you go into this coffee shop and you asked if a masked employee can make your food or drink because you aren't vaccinated now what you're doing is called asking for a courtesy that is something that people don't seem to understand anymore about doing business. First of all business is about negotiation it's about a customer wanting a service and exchanging money for a service therefore the customer might request an accommodation they might request something extra something less they might request a special request have you seen in McDonald's they have special request buttons on their kiosks when you order there's an example of how a customer might request something to be changed or different or if they're disabled they might require a reasonable accommodation for their disability.
So it is not unusual for a customer to calmly negotiate with either a store owner or an employee and ask if they can accommodate them now if there's a refusal the customer should leave say thank you and simply find another location to patronize. So there's no conflict there's no breaking of laws there's no aggressive behavior from the customer it's simply a request which is not unusual in business.
And by the way most coffee shops and stores are doing this as a courtesy the coffee shops in question most of them if you request that a certain employee make your food because they are also masked up is usually not a problem they usually provide that accommodation there's no reason that they wouldn't if they want the business and you're not putting anybody out on a limb or inconvenience in anyone because the employee is already masked up.
And the employees that are masked up at these coffee shops by the way I want to thank you for whatever your reasons are for wearing a mask I appreciate it. And also the people that are masked up that are providing the accommodation I usually happy to do so because they understand obviously they're wearing a mask.
The conflict is not with the general employees in the store the managers or with the customer it is always with one single employee who is seems to be a resident troublemaker. I've experienced this in four different locations in the Boston area Metro Boston and one in the suburbs. And in each and every instance it's only One singular employee none of the other employees seem to be on board or even in agreement with any kind of causing conflict with a customer over these issues. In fact other employees seem nervous intimidated they seem very uncomfortable with their fellow employee causing trouble for a customer so if you went into a courtroom you could also bring up the issue of the harassment of the customer by a single employee is causing some kind of duress to the employees themselves experiencing harassment or violence always has an effect of being traumatizing to the onlookers to the bystanders so you can even bring that up as an angle.
So what's usually occurring is that a person goes in who's got a mask on because they're not vaccinated for whatever the reasons are they walk into this particular donut coffee shop this coffee chain if there is nobody masking up they will request someone who's masked if the person who's the customer is informed that nobody is masking up in that store they simply politely agree to not make their purchase there and walk out the door amiably.
If there is somebody masked up who's an employee who's capable of performing the task of preparing their food or drink for the customer the customer requests that that person do it instead of the person who's on mask who is planning to do so.
If there is an agreement with the employees and the company that that's an accommodation has a courtesy that can be accomplished for the customer all goes well the service is performed the food is served and the payment is made end of story. Now usually this is what is occurring and usually it occurs with no problems or no conflict most stores are happy to let somebody who's already masked up perform this service because they want the money and they want to avoid any more feelings of fear or terror having to do with the pandemic remember how nice companies were during the pandemic because everybody understood that it's scary and frightening and very traumatizing for everybody around the world and I see that continuing in various locations of this chain where people understand that this isn't over and the whole thing has been very traumatizing we're talking about a plague that kills people.
Therefore it doesn't make any logical sense by any standards that only one singular employee present in a location would start harassing the customer harassing the person who's the employee who's agreed to make the food or coffee for that customer mocking the customer arguing with them being nasty to them fighting with them there is no logical reason for that person to take that action.
You're not supposed to be politicizing making coffee and serving food you work in a store in order to provide a service to customers get paid to do so. This isn't just young kids of the antifa generation who believe that everything is politicized because that's what I thought it was and I don't think it's the generation of kids who get offended by everything either because that's also what I thought it was.
It seems to be and I dare put this forward as a conspiracy theory remember this is just a theory and I have a right to my freedom of speech especially cuz I'm establishing it's a theory but my conspiracy theory on this issue is that there seems to be in place in certain locations of this particular chain I haven't experienced in other places yet I will let you know if I do but there seems to be a pattern of which doesn't make any logical sense when you think about it logically and with common sense that anybody would take this action it doesn't make sense why would you do that what is your motive is it political well that doesn't make sense because just 6 months ago and last year people were screaming at people whose masks were pulled down people were screaming and people that didn't have a mask on so how does it make sense that now you're going to be offended and harassing someone who is still wearing a mask?
I put forward that there's a conspiracy theory of people taking up jobs and being in residence in certain store locations and their job for however the hell it works is to harass anybody who isn't vaccinated is unmasked and requests a person who is masked to make their food as part of some kind of intrigue involved in supporting a political agenda or whatever kind of agenda it might be.
Now if you're being harassed in this way for not being vaccinated don't bring forth any conspiracy theories that's just for the future because of course most conspiracy theories that are brought forth with evidence in the beginning of actual harassment occurring or something occurring that doesn't make sense years later it does come out that it actually was a conspiracy so you have to build a case as it were.
So what I would do is simply report the harassment in individual cases to corporate now you're going to go to the diversity and inclusion department and or the discrimination report department because it isn't just a complaint about that employee behavior you're being discriminated against because you're not vaccinated and you're being harassed based on that because the customer has a right to request something be changed or an accommodation and if both parties agree in the store there should be no interference from another employee therefore you are being harassed based on not being vaccinated so you need to report it to the appropriate department. Then if it happens enough time I think we should start a class action lawsuit and I should also think that maybe we can go to the federal government and request that not being vaccinated be a disability and you become a protected class or at least be a protected class because there's active harassment going on.
But that's in the future when you present your complaint to the corporate entity that runs the company please give your name give your email and your phone number I use a certain email for activism and advocacy when it comes to all these different kind of complaints are harassment and I use that exclusively just for that I suggest you start an email just for this issue because there's going to be other instances of harassment and then you can keep it straight as to what the subject matter is.
I don't think that this is GS theory what I think is that there's something else going on with anti-vax or non-vax. And if you think about it the number one thing that doesn't make any sense is the amount of energy the person is putting into harassing the person that is requesting accommodation because they're not vaccinated. What would motivate that? It doesn't make any sense especially because just a short time ago people were freaking out if you didn't have a mask on. So I don't think that this is just a very politicized generation that gets offended by everything and thinks that everything is a civil rights issue.
In other words you're taking the raised fish if you're my age you see on revolutionary bookstores places like Cambridge 30 years ago before these kids were even born that raised this revolution has become streamlined armchair it's become part of everything that these kids think and do they don't understand the difference seemingly between capitalist system working in a job and something that's an activist issue an issue with advocacy a social issue or a political issue to them it's intertwined which is the fault of corporate and it's the fault of the parents. You got to explain to your children that we live in a capitalist society and they wouldn't have iPhones in their hand if we didn't and that if they go to make a money at a job unless it's a job having to do with politics or social issues they shouldn't be politicizing anything to do with performing a service to get paid.
I've already complained to the company of which I cannot name here because I don't want somebody to think that they have another opportunity to send threatening emails to anybody inside my name to it I'm not falling for that again.
Put a disclaimer on the top of this that says no emails are going to be sent by me so if somebody sends you emails threatening you it's not me.
So document every instance of this happening with corporate make it a discrimination case get a case number give them your email and make sure you hear back and I also want to make it clear that the kid involved today and what happened where I did file a report immediately try to lie to the manager who I've known for years and have never had a problem with that I screamed at him well I explained to him that that isn't the case and he apologized for the kids behavior but he didn't discipline them again you're not disciplining these kids.
I know everyone is desperate to hire people but you still have to follow the rules and you can't go around breaking laws and thinking you're a little terrorist working in a job just because you're young and full of spitfire and ready for war if you want to go to war join the military if you want to do activism for social issues go work in a soup kitchen or a homeless shelter corporate is not the appropriate place to cause trouble and masking is not a political issue it is a medical issue and there should be much picture laws and there should have been much Richter laws this entire time with various aspects of the pandemic.
This was my grandmother's day world war II generation you would have had rationing on day one it would have been no panic shopping and no boarding the second thing is there would be no shipping wars because the governments would all call an international emergency and bring in volunteers and military ships to get this stuff where it's supposed to go I don't think the public even realize that the reason they're not getting stuff on their shelves is The shipping wars.
So in a way capitalist corporate society has actually made the pandemic harder by not making it into an issue that's run by governments run by CDC or medical experts it's run by the dollar and also another reason that we still have little pockets of pandemic is I don't think the public's aware that the big companies that make the vaccines they're not allowing third world countries to have their patent because they're greedy for money so they can't get the vaccines or they couldn't in the past two years. So even though everyone is spewing all of this bullshit about where in this together you have to realize that there's no oversight and accountability because it's all following the dollar and corporate again this is what people like me are working on this is what our generation warned you about in the 90s and you're not even paying attention.
Now you've got little sjw kids or whatever they are who knows if they're offered is or whatever harassing people in retail stores freely without worry of getting in trouble because there's no control there's no oversight from governments and you've got people convinced that the government is still the enemy like it was 50 years ago 40 years ago it's not it's the court photography and the medical industrial complex in big pharma not the enemy per se but it's not being regulated and there's no accountability and oversight to the average person because they're not a government how are you supposed to find out what's going on?
So you need to control your environment when you can. And the way to do it is to have some self-respect like I do and take the time to report these issues to corporate and make sure that if you can base it on discrimination you go right to the discrimination department because there is no reason that people that cannot get vaccinated for medical reasons religious reasons whatever it is should be being harassed.
